Lyft carries the same layered coverage structure as the rest of the industry, and the three periods that decide which policy applies work the same way. What differs is the claims process you meet afterwards and what it asks of you.
We act for Lyft passengers, for drivers struck by a Lyft, and for pedestrians and cyclists. The aim is the same in each: fix the app status in evidence, put every applicable insurer on notice, and keep you out of a recorded statement until the injuries are understood.
What actually proves a Lyft claim
- Your ride history. Passengers hold their own proof. The trip shows the driver, the vehicle, the route and the times. Screenshot it the same day.
- The driver's app status, held by Lyft, which decides whether the large commercial policy or a much smaller contingent one applies.
- The police report, which links the vehicle and driver to the collision and frequently notes that it was a rideshare trip.
- Medical records that start immediately. A gap between the crash and the first appointment is the most common argument used to reduce these claims.
- Dashcam or nearby camera footage, which is usually overwritten within days and has to be requested quickly.
Silver Spring, Montgomery County and the DC line
Our strongest visibility for Lyft claims is around Silver Spring, and that reflects the real pattern: heavy late-night rideshare use around the Metro, the Beltway and the Georgia Avenue and Colesville Road corridors, in a county that borders the District.
That border matters. A ride that starts in Silver Spring and ends in the District, or vice versa, can put the collision under different law depending on where it happened. Our Silver Spring office handles these directly, and claims arising in Maryland stay in Maryland courts.
If you were the passenger
Passengers hold the strongest position in any rideshare claim. You were not driving, so you are almost never exposed to Maryland's contributory negligence rule, which can otherwise bar a claim outright over a small share of blame.
It also means you do not have to choose sides between the two drivers. If fault is disputed between your Lyft driver and another motorist, a passenger's claim can proceed against the responsible party once that is resolved, and both carriers can be put on notice in the meantime.
What a Lyft claim is worth
The brand does not set the value. These do:
- The seriousness and permanence of the injury, and how long treatment runs
- Which coverage period applied, because that sets the ceiling
- Lost income and any effect on future earning capacity
- Whether liability is clean or contested
Maryland caps non-economic damages such as pain and suffering and adjusts that cap over time; medical costs and lost earnings are not capped. Past results in other cases do not predict any particular outcome.
